These Terms of Use (“Terms”) govern your access to and use of our website, related communication channels, and the proofreading, editing, reviewing, and feedback services available through the Platform. By accessing the Platform, requesting assistance, communicating with our team, or using any service offered through the Platform, you acknowledge that you have read, understood, and agreed to comply with these Terms. If you do not accept these Terms, you should discontinue use of the Platform immediately. These Terms constitute a legally binding agreement between you and the Platform to the fullest extent permitted under applicable United States law.

1. Definitions

For the purposes of these Terms:

  • “Platform” means NerdAdvisory.com, together with all related communication channels, software, features, and services operated by us.
  • “User,” “Client,” “you,” or “your” refers to any individual who visits the Platform, submits texts, communicates with our representatives, or uses any service available through the Platform.
  • “Nerd(s)” refers to an individual engaged by the Platform to provide proofreading, editing, reviewing, formatting assistance, language improvement, or learning feedback and support.
  • “Services” means proofreading, editing, document review, formatting assistance, language refinement, citation review, feedback, and similar learning support intended to improve the clarity, accuracy, and presentation of a User’s own work.
  • “Terms” refers to this Terms of Use document together with any policies incorporated.

2. About the Platform

The Platform provides learning support designed to help clients improve the quality, organization, readability, grammar, formatting, and overall presentation of texts they have prepared themselves. Our services are intended solely to assist Users in developing their own skills through professional proofreading, editing, reviewing, and constructive feedback.

Depending on the nature of the request, the Platform may connect a User with a qualified Nerd (an editor or reviewer) with relevant experience. Nerds evaluate submitted texts and files, identify language or formatting issues, provide recommendations, suggest changes, and help improve clarity while preserving the User’s original ideas and intended meaning.

Our services are not intended to promote dishonesty or misuse. Users remain fully responsible for the content they submit, any decisions regarding acceptance of suggested changes, and compliance with the policies of their institution, employer, licensing authority, or other applicable organization.

3. User Responsibilities

When using the Platform, each User agrees to:

  • Use the Platform only for lawful and legitimate purposes.
  • Provide accurate, complete, and understandable information regarding the requested service.
  • Ensure that all submitted information and texts may legally be shared with the Platform and do not infringe upon the intellectual property or other rights of third parties.
  • Communicate respectfully with Nerds, customer support representatives, and other Platform personnel.
  • Carefully review all service details, pricing information, estimated timeframes, and applicable policies before confirming payment.
  • Use the Platform in a manner consistent with institutional policies, ethical standards, and applicable United States laws.
  • Refrain from requesting assistance involving fraud, copyright infringement, deceptive conduct, impersonation, or any other unlawful activity.

The Platform reserves the right to decline, suspend, or discontinue any request if we reasonably believe that the requested service violates these Terms, applicable law, intellectual property rights, or accepted standards of ethical conduct. We may also refuse service where the requested activity exposes the Platform, its personnel, or third parties to legal or regulatory risk.

4. Service Delivery

4.1. How Services Are Provided

Services may be delivered using one or more approved communication channels, including:

  • Live chat
  • Email
  • SMS, where available
  • WhatsApp

Although we make commercially reasonable efforts to provide services within the estimated timeframe, delays may occur due to incomplete information provided, technical interruptions, or circumstances beyond our reasonable control.

4.3. Changes to User Instructions

If a User requests additional editing, expands the scope of the requested service, or provides significant new information after work has begun, the estimated timeframe, applicable fees, or scope of service may require adjustment. The Platform will notify the User of any proposed changes before additional services are performed, allowing the User to determine whether to proceed under the changed terms.

5. Intellectual Property

5.1. Permitted Use

Reviews, texts, or services returned through the Platform are intended solely to support the User’s personal learning and skill development. Subject to these Terms, Users may:

  • Review proofreading suggestions to improve grammar, punctuation, spelling, and language accuracy.
  • Apply editing recommendations to enhance organization, readability, consistency, and formatting.
  • Consider reviewer comments when improving future texts.
  • Use feedback to strengthen communication skills and better understand language conventions.
  • Retain copies of edited texts for personal, non-commercial use.

Nothing in these Terms transfers ownership of the Platform’s intellectual property to the User except for the limited rights expressly granted herein.

5.2. Prohibited Use

Users agree that they will not:

  • Represent edits, comments, or content developed collaboratively through the Platform as the sole independent work of the User where doing so violates applicable institutional policies.
  • Copy, reproduce, publish, distribute, license, sell, or otherwise exploit Platform content without prior authorization.
  • Use the Platform’s services or content for commercial purposes.
  • Remove copyright notices, proprietary markings, or other ownership identifiers contained within Platform content.

Any use inconsistent with these Terms may result in suspension of access and additional legal remedies where permitted by law.

5.3. Ownership

The Platform retains all rights, title, and interest in its website, branding, software, editing methodologies, reviewer comments, feedback templates, formatting guidance, and all other proprietary content created or supplied through the Platform.

Users receive a limited, revocable, non-exclusive, non-transferable license to use the delivered feedback and edited texts solely for personal purposes in accordance with these Terms. No ownership rights are transferred to the User through use of the Platform. All intellectual property rights are protected by applicable United States copyright laws, including the Copyright Act of 1976, together with other applicable federal and state intellectual property laws.

5.4. Violations

Unauthorized use of Platform content or infringement of intellectual property rights may result in one or more of the following actions:

  • Suspension or termination of access to the Platform.
  • Refusal to provide future services.
  • Removal of unauthorized content where applicable.
  • Notification to appropriate parties where required by applicable law.
  • Civil or other legal remedies available under United States law, including claims relating to copyright infringement or misuse of proprietary content.

The Platform reserves all rights available under applicable federal and state laws to protect its intellectual property and business interests.

6. Age Requirements

The Platform is intended exclusively for individuals who are at least eighteen (18) years of age.

By accessing the Platform, communicating with our representatives, or making a payment, you represent and warrant that you are at least eighteen years old and possess the legal capacity to enter into a binding agreement under applicable United States law.

We do not knowingly collect personal information from individuals under the age of eighteen or knowingly provide services to minors. If we become aware that information has been submitted by a person under eighteen without appropriate legal authorization, we may delete the information, discontinue the associated service, and take any other action permitted by applicable law.

7. Payment Terms

7.1. Accepted Payment Methods

Bank transfers may also be accepted in selected circumstances upon prior approval.

Payment transactions are processed by independent third-party payment processors utilizing commercially reasonable security measures and encrypted payment technology. The Platform does not store complete payment card information unless required for lawful business purposes.

7.2. Payment Conditions

Payment must be successfully received before proofreading, editing, reviewing, or related services begin. Service fees are determined using factors such as the type of requested service, text length, editing complexity, formatting requirements, level of review requested, timeframe, and required subject expertise.

Users are responsible for carefully reviewing the selected services and pricing before authorizing payment. Failed, disputed, reversed, or incomplete payments may result in suspension, cancellation, or delayed processing of the requested services. Nothing in this section limits any rights provided to consumers under applicable federal or state consumer protection laws.

7.3. Pricing Transparency

The Platform is committed to maintaining clear and straightforward pricing. Before any service begins, Users will receive a price estimate describing the requested services, anticipated scope, and associated fees so they can make an informed decision before proceeding. We do not impose hidden charges. If additional services become necessary because the User expands the requested scope after work has started, any changed pricing will be communicated in advance. No additional charges will be applied without the User’s prior approval.

7.4. Currency and Additional Fees

Unless otherwise specified, all payments are processed in United States Dollars (USD). Depending on the User’s financial institution, payment provider, geographic location, or selected payment method, additional charges may apply. These may include currency conversion fees, international transaction fees, banking fees, taxes, or similar charges assessed by third parties.

Such fees are determined exclusively by the User’s financial institution or payment provider and are not retained or controlled by the Platform. Users are solely responsible for reviewing any applicable charges before completing payment.

7.5. Receipts and Billing Records

Following successful payment, the Platform will provide an electronic payment confirmation and receipt using the email address supplied by the User. Clients requiring additional billing documentation or a formal invoice may contact our support team. Payment records may be retained for accounting, tax, fraud prevention, customer service, legal compliance, and other legitimate business purposes in accordance with applicable United States laws and our Privacy Policy.

8. Refund Policy

Refund requests are evaluated individually based on the specific facts and circumstances surrounding each service. A User may qualify for a full or partial refund if, for example:

  • The completed service materially differs from the agreed scope.
  • A duplicate payment or processing error resulted in an incorrect charge.
  • The Platform was unable to deliver the agreed service within the estimated timeframe without prior communication, and no mutually acceptable solution could be reached.
  • A technical issue attributable to the Platform prevented the provision of the requested service.

Refund eligibility will be determined after reviewing all relevant communications, submitted documents, payment records, and the work performed by the Platform. Refunds generally will not be issued when:

  • The User supplied incomplete, inaccurate, inconsistent, or misleading information.
  • The User requested substantial changes or expanded the scope after services had already begun.
  • The User accepted the delivered service without promptly reporting any concerns.
  • The refund request is submitted more than ten (10) calendar days after delivery of the service.
  • Dissatisfaction results solely from personal preference where the requested services were provided substantially as agreed.

To request a refund, Users should contact our support team at [email protected] and provide sufficient information to identify the transaction, including their name, payment details, a description of the issue, and any supporting documentation reasonably requested by the Platform.

If a refund is approved, reimbursement will ordinarily be issued using the original payment method. Processing times depend on the applicable payment processor or financial institution and are outside the Platform’s control. Nothing in this Refund Policy limits any non-waivable consumer rights that may apply under federal or state consumer protection laws within the United States.

9. Third-Party Services

To operate efficiently and securely, the Platform may utilize trusted third-party service providers that assist with various business functions, including but not limited to:

Accordingly, the Platform is not responsible for the actions, omissions, interruptions, or policies of third-party providers that operate independently of our organization.

10. Governing Law and Dispute Resolution

These Terms, together with any dispute, claim, controversy, or legal matter arising from or relating to the Platform or the services provided, shall be governed by and interpreted in accordance with the laws of the United States and, where applicable, the laws of the state in which the Platform is operated, without regard to conflict of law principles. Nothing in these Terms limits any mandatory rights available to consumers under applicable federal or state consumer protection statutes.

If a disagreement arises, Users agree to first contact the Platform’s support team and make a good-faith effort to resolve the matter through informal discussions. Most concerns can be addressed efficiently through direct communication. If the parties are unable to resolve the matter informally, either party may pursue any remedies available under applicable law. Where permitted, disputes may be resolved through negotiation, mediation, arbitration by mutual agreement, or proceedings before a court of competent jurisdiction, including small claims court when applicable.
